Arent Fox defended and successfully resolved group boycott antitrust claims against a radiology group practice brought by a competitor’s practice. The suit, Eastside Medical Radiology, PLLC v. Carecore National, LLC et al,  1:11-cv-09494-VM-GWG, filed in the Southern District of New York, alleged that competitors colluded to exclude the plaintiff from access to key insurance contracts.  Arent Fox leveraged novel defenses and innovative discovery strategies in response to aggressive action by the plaintiff’s attorneys, who had successfully brought several, related lawsuits and obtained a significant award in a parallel jury trial.  The Arent Fox team ultimately was able to conclude the matter for our client as part of a multi-party resolution of the matter.
