Arent Fox International Trade 2011 Issues Preview
On behalf of all of us in the International Trade Practice, we wish you a Happy New Year, and hope that 2011 will bring new opportunities and a revitalized economy.
No doubt, many of you have seen a distinct increase in trade activity in 2010, especially in the last half of the year. Mirroring this rise in economic activity is an increase in policy, legislative and regulatory initiatives. After a relatively calm (if not moribund) nine months, 2010 ended with a flurry of activity. We have the Bureau of Industry and Security and Department of State openly proposing merging export control lists, new import safety rules for food products, Customs and Border Protection suggesting new limits on prior disclosures, the largest set of proposed rule changes for trade litigation (antidumping and countervailing duty) cases in 15 years, a potential breakthrough for an FTA with Korea, and the loss of GSP benefits. Many of these changes will take effect in 2011, and most certainly will affect international business. In our 2011 Issues Preview, we offer a glimpse of some of these changes.
