At the Border, Fees Are Hurting Trade
Arent Fox partner Matthew Nolan has been published in a recent edition of Legal Times with an article exploring how security issues are impacting the United States' trade relations with Canada.
“Over the years, the economies of the two countries have grown ever closer together. Today, they are practically intertwined. ... But the post-9/11 environment has heightened the focus on security, including border management with Canada. This new environment is characterized by numerous 'enhanced' security measures, and attendant fees, which tend to restrict or reduce the benefits of cross-border trade. These measures were initially imposed indiscriminately with little regard for the potential adverse effects on cross-border trade, and without sufficient consultation or cooperation with our Canadian neighbors,” Matt writes. “Although more recent initiatives have attempted to reverse this course to some extent, we are still in an environment where security tends to trump trade, even though it should be possible to achieve both without injuring either.”
