DOJ’s First Conviction of a Corporation for FCPA Violations Reversed

In an opinion dated on December 1, a federal court in California reversed the convictions of Lindsey Manufacturing Co. and two of its executives. US District Court Judge Howard Matz reversed the jury convictions on the grounds that the defendants’ due process rights had been violated by multiple acts of misconduct made by prosecutors in pursuit of the convictions. This case has generated significant attention because it produced the first conviction of a corporation for violations of the Foreign Corrupt Practices Act.
