New After Hours Video Podcast on Where California Employment Class Actions Go After AT&T Mobility
AT&T Mobility LLC v. Concepcion, 131 S.Ct. 1740 (2011) applied the Federal Arbitration Act to uphold a “class action waiver” and overrule a key California doctrine that had prevented enforcement of arbitration provisions making disputes individual cases rather than class actions. AT&T Mobility was one of the most heralded US Supreme Court cases of the year, and its effect in California on employment class actions has been equally and unsurprisingly tumultuous. Join Harry as he discusses AT&T Mobility, what it means for employers and their arbitration agreements in the face of an employment class action, and how lower courts in California have interpreted it. Harry covers Brown v. Ralph’s Grocery Co., 197 Cal. App. 4th 489 (2011), review denied 10/19/11, and how Brown now throws another wrinkle into arbitration agreement enforcement in California. For those employers that are exploring arbitration agreements as an alternative to suffering repeated employment class actions in California, such as wage-hour class and representative actions, Harry hopes to offer insight into the future.
