Discussion topics will include customs and imports, export controls, Foreign Corrupt Practices Act (FCPA) and anti-corruption issues in the health care/life sciences industry.
EXPORT CONTROLS: After a brief introduction to the basics of export controls, our panel will take on the last year's export control developments, including:
-The China military end-use rule and what it means for your business
-The new increased civil and criminal fines for violations of the Export Administration Regulations (EAR) and OFAC regimes and how the Department of Commerce Bureau of Industry and Security (BIS) and OFAC have been using their new-found power
-New International Traffic in Arms Regulations (ITAR) developments, including the UK and Australia treaties, changes to third country and dual nationals in TAAs and MLAs, the proposed rule on aircraft parts and components, and DDTC's "Directed Disclosure" primer
-Recent enforcement trends involving embargoed countries such as Iran, deemed exports, and economic espionage
-New regulations to watch for, including BIS's soon to be proposed inter-company rule
IMPORT COMPLIANCE: This panel will first discuss the basics of import compliance, including a description of the import transaction, the importer's obligations with respect to its Customs broker; and Customs information and recordkeeping requirements. Following this introduction, we will address current issues such as:
-How free trade agreements and other duty savings programs can save you money;
-The best practices for import compliance programs;
-How to respond to a Customs enforcement action;
-How recent security initiatives by Customs can affect your imports.
FCPA AND LIFE SCIENCES: After a brief introduction to the basics of FCPA, our panel will review the latest enforcement cases involving the medical device and life sciences industry, and discuss lessons learned from those cases. We will also review current best practices in the life sciences industry, including due diligence on intermediaries, compliance programs that work, and compliance monitoring.
