Connie Raffa and Rachel Hold-Weiss to Speak at New England Home Care Conference and Trade Show 2012

Arent Fox partners Connie Raffa and Rachel Hold-Weiss will be speaking on “Targeted Risk Areas for Home Care Agencies and Compliance Strategies in Home Care” and “Legal Aspects of Marketing: Advantages and Consequences for Home Health Agencies and Hospices and Impact of the Affordable Care Act” at the 2012 New England Home Care Conference and Trade Show.

Home Health Agencies are the target of audits and investigations by many government entities including CMS, OIG, DOJ, MFCU, ZPIC, Recovery Audit Contractors, and Medicare Reviews. Home health care rules are constantly changing and new requirements have been added to the 31 OIG risk areas. Connie and Rachel will address new regulatory requirements; risk areas; which practices the government is scrutinizing more closely; and how to identify areas of improvement and new compliance strategies for your agency.

The Affordable Care Act (ACA) amends the definition of remuneration to exclude certain charitable and innocuous programs. This change will impact OIG Advisory Opinions. Certain marketing activities that in the past were questionable may be permitted. Connie and Rachel will identify legal and illegal marketing practices as well as how employees, customers, and competitors can become whistleblowers and what you can and cannot do based on OIG Advisory Opinions, Work Plans, Fraud Alerts, Safe Harbors, and Compliance Plans.
