Getting Ready for RAC
In the Tax Relief and Recovery Act of 2006, Congress made the Recovery Audit Contractors (RAC) program permanent and required CMS to contract with five RACs and expand the program to all 50 states no later than January 1, 2010. RACs will conduct automated and complex review audits of all provider types to identify paid Medicare fee-for-service claims that are the basis of an overpayment or underpayment. RACs are compensated on a contingency-fee basis. Providers have appeal rights, but recoupments will be swift.
