Leah Eisenberg will present at American Bankruptcy Institute’s 14th Annual New York City Bankruptcy Conference. She will present on the “Intersection of Securities and Bankruptcy Law” panel, addressing the following questions: How broad is the bankruptcy exemption to securities laws? How should public company reporting requirements be met by a debtor in possession? Can a bankruptcy plan and disclosure statement be used to raise new capital through a rights offering without a registration? When do securities laws prevent rights offerings in bankruptcy plans? What is the impact on public noteholders of direct participation in bankruptcy plan negotiations? When are such noteholders restricted by such discussions? How do they get unrestricted?
