Arent Fox Partner Jule Rousseau Quoted in The Life Settlements Report

    Arent Fox partner Jule Rousseau was quoted in the October 12, 2011, edition of The Life Settlements Report. In an article titled “Pennsylvania Court Favors Investors on Intent Issue,” Jule comments on a Pennsylvania federal court decision in an insurable interest case in which the court rejected the carrier view that an insured’s intent is relevant when taking out life insurance.

    The Life Settlements Report writes, “’It basically says [the] Kramer [decision] got it right and the Pennsylvania law isn’t even debatable on insurable interest,’ said Jule Rousseau, a partner with the Arent Fox law firm. ‘And what made the case easy was that it was a premium-finance case. The beneficiaries have insurable interest.’ He said that the court decision goes along with the Arthur Kramer case, which was decided a year ago, and also puts Pennsylvania in line with New York, California, Arizona, Delaware, and Minnesota on the issue. The Kramer ruling last November by the New York State Court of Appeals held that a person can take out a policy on his or her own life and immediately transfer it to whomever the person wants.”

    Jule was quoted in The Wall Street Journal last November when the decision in the closely watched insurance litigation Kramer v. Phoenix Life Insurance Co., et al., was issued.
