Arent Fox Partner Linda Baumann Comments on Pay-for-Quality Arrangements for Physicians As It Relates to Self-Referral Law

Arent Fox Health Care partner Linda A. Baumann was quoted extensively in Bloomberg BNA’s Health Care Fraud Report in an article on recent concerns surrounding the Stark Law that prohibits physician self-referrals.

The article “Self-Referral Law Seen as Barrier to New Provider Arrangements” provides perspectives on a proposed rule by the federal government that would begin implementing a new quality-based payment structure for Medicare doctors.

Linda, along with a number of other attorneys, told Bloomberg BNA that this will cause doctors and hospitals to shy away from these pay-for-quality arrangements out of fear that the current federal fraud and abuse laws may prohibit the kind of arrangements necessary to make these deals work.

Linda also went on to suggest several potential solutions for the government to consider to work around these Stark issues, such as changing the legislation or expediting the advisory opinion process.
