Arent Fox partner Linda Baumann was quoted in a September 26 article in Modern Healthcare. The article, “Veiled disclosures: Providers eager to know extent of CMS' leniency for Stark law violators,” reports on how the Centers for Medicare & Medicaid Services (CMS) are implementing rules on how health care providers can “turn themselves in for violating the highly punitive Stark law on physician self-referral.” The new self-disclosure protocol, which went into effect on September 23, 2010, “gives CMS regulator an ability – but not a mandate—to reduce health care providers’ liability when they turn themselves in.”
