California Rail Agency May Trump Transit-Oriented Housing in Bay Area

On June 28, Real Estate partner Tim Tosta spoke with the San Francisco Chronicle on the latest debate surrounding a tract of former industrial land in the Bay Area.

Though long-standing plans envisioned developing one of the area’s largest mixed-use projects there, the California High-Speed Rail Authority recently selected the land as a preferred site for a train maintenance yard.

Speaking on the political plays behind these types of land use decisions, Tim told the Chronicle  that the property owner will have little power to influence plans once the authority identifies land it intends to seize.

“They are just going to have to take it on the chin,” said Tim. “The condemning authority has a right to take the land, and then you fight over the money later.” Tim previously represented a property owner whose land was taken by the Transbay Joint Powers Authority.
