The Huffington Post and USA Today Quote Pamela Deese on Violation of Client’s “Linsanity” Trademark
An article in The Huffington Post quotes Arent Fox partner Pamela Deese regarding her efforts to protect the “Linsanity” trademark rights of client Jeremy Lin.
In discussing the cease-and-desist letters sent to various medical marijuana dispensaries offering “Linsanity” brand marijuana, Pam states, “Their enthusiasm for Jeremy Lin got ahead of their understanding of the law,” with The Huffington Post noting that at least three of the dispensaries have since stopped offering the product.
The article, which has since been covered in numerous publications including USA Today, quotes Pam on the cease-and-desist letters to 24 entities who applied for a trademark on “Linsanity” or some other Lin term. “You can’t file a trademark when there’s a clear connection to someone else’s name,” she said. “In this case, Jeremy Lin has the right to his name and related names and marks, as well as his signature, voice and likeness. That’s all part of his intellectual property.”
