Inside Counsel Highlights Pam Deese’s Work Following $69 Million Fraud and Trademark Infringement Win for SD-3C

Intellectual Property partner Pamela Deese was featured by Inside Counsel for her work on a team from Arent Fox that recently secured a summary judgment of more than $69 million for SD-3C LLC.

In the decision, a federal judge ruled that two Chinese companies and four of their executives were guilty of fraud, trademark infringement and breach of contract after underreporting sales and royalties on the sale of memory card technology licensed by SD-3C .

This was a tremendous victory not only for SD-3C, but also for companies across the country intent on protecting their intellectual property from foreign companies operating in breach of a license agreement and continuing to sell patented and trademarked products after an agreement is terminated,” Ms. Deese told Inside Counsel. “The case involved a good amount of fraud on the part of the defendants and required creative ‘digging’ at our end to prove.

Ms. Deese added that Arent Fox conducted extensive investigations in several countries to find that the defendants faked invoices and devised an “elaborate corporate structure” to try to hide actual sales. “Building a strong case while navigating a variety of obstacles is what made the case challenging and the result gratifying,” she said.
