Practice Areas
Randy Brater is a partner in the commercial and intellectual property litigation groups at Arent Fox. He has experience defending and pursuing civil actions in numerous areas including a variety of tort and contract actions, environmental actions under CERCLA, trademark infringement, insurance disputes, claims under the False Claims Act and trade secret actions. Randy has assisted in and been responsible for all facets of litigation in both state and federal courts from preliminary injunctions to motions practice to jury and bench trials, as well as arbitrations and mediation.
Randy is also an active participant in firm activities. He is a member of the firm’s Employment Committee that is responsible for the hiring of summer associates, oversight of the firm’s summer program and hiring of new associates. Randy is also a member of the firm’s Strategic Technology Committee that is committed to the development and streamlining of new technologies to better serve the firm’s clients.
Client Work
Most recently, Randy was part of the litigation team that defended a trademark infringement and dilution action on behalf of a major media and entertainment company in a jury trial. The case settled on favorable terms to the client, but not before partial dismissal of the action at both the motion to dismiss and summary judgment phases.
Other significant matters in which Randy recently participated include:
- Representation of a sovereign nation in a breach of contract action, prevailing on a Motion to Dismiss
- Representation of a professional sports franchise in the arbitration of an insurance dispute
- Part of the trial team that litigated a contract counterclaim in a bench trial
- A CERCLA claim at summary judgment, including a determination that the client was an innocent landowner under the statute
Randy is also committed to pro bono activities. He is currently the coordinator of the Arent Fox attorneys that perform intake at the Legal Aid Society of the District of Columbia and has performed intake at Legal Aid since 2002.

Randy joined the firm in 2001 after working at a law firm in Los Angeles.
