He practices in all areas of intellectual property, with a focus on patent prosecution, counseling and litigation in pharmaceuticals, nutraceuticals, cosmetics, foods, organic, and inorganic chemistry, polymers, medical devices, and biotechnology. David has extensive experience in counseling and defending generic pharmaceutical companies with respect to Hatch-Waxman litigation. Client Work David advises clients in the life sciences on obtaining, enforcing, and designing around patents. This includes preparing and prosecuting patent applications, providing opinions relating to the infringement or validity of patents, licensing, and due diligence investigations of third-party intellectual property portfolios. David has specialized experience in advising generic pharmaceutical companies regarding strategies for filing Abbreviated New Drug Application, including the development of non-infringement and invalidity positions against patents listed by brand companies in the Food and Drug Administration’s Orange Book. Previous Work Prior to joining Arent Fox, David was a partner at a national intellectual property law firm. Professional Activities David is an active member of the American Bar Association and the American Intellectual Property Law Association. Publications, Presentations and Recognitions David is a frequent lecturer and author on topics such as prosecution tips and strategies, case law developments in the US Court of Appeals for the Federal Circuit, prosecution history estoppel, and interviewing strategies. He has also been a judge in the Sutherland Moot Court competition and a faculty member of the Practicing Law Institute.
