Represented two midsized federal saving and loan associations in hundreds of foreclosures and loan restructurings encompassing all types of collateral prior to the Resolution Trust Corporation’s (RTC) intervention at both banks in 1992.
Represented a major investment bank with respect to its acquisition of a defaulted $15 million first mortgage loan secured by commercial office building. Initiated foreclosure proceedings against the borrower, initially stayed by the Chapter 11 bankruptcy filing of the borrower, based upon the springing recourse provisions under loan documents.
Negotiated a workout, eventual deed-in-lieu documentation, and transfer of properties to lender that made a $122 million loan on behalf of major Wall Street opportunity fund client of 13 student housing properties located throughout the United States.
Represented a real estate investment company in the negotiation and drafting of a forbearance and settlement agreement between the client, Frank M. Perper Motel Associates, and the owners of three motels in Pennsylvania as well as in the foreclosure of all three properties after negotiations broke down.
Represented Teachers Insurance and Annuity Association of America in a $51 million foreclosure proceeding in Maryland.
Represented New England Mutual Life Insurance Company in a $44 million foreclosure proceeding in Maryland.
