Copyright Royalty Rate-Setting Proceedings

Arent Fox attorneys routinely represent clients in royalty rate-setting proceedings. One venue for such proceedings is the Copyright Royalty Board, which sets royalty rates and distributes payments for various compulsory licenses contained in the United States Copyright Act. Other venues for rate-setting litigation include the ASCAP and BMI rate courts.

Irrespective of venue, these high-stakes proceedings set royalty rates applicable to entire industry segments. Success requires knowledge of the legal standards and precedents applicable in each venue, understanding of the particular industry segments (both on the copyright owner side and the copyright user side), the ability to work with top economists and other witnesses to provide compelling evidence, and experience with the unique and at times unusual procedural rules applicable in each forum.

Arent Fox's ability to assemble multidisciplinary teams with experience across many subject matter and industry practices, including specific experience in each of these rate-setting venues, places our firm at the top of a very short list of the most qualified and experienced firms to handle these matters.
