Public Accommodations/Fair Housing

Federal, state, and local laws impose significant nondiscrimination obligations on businesses, buildings, professionals, and commercial and nonprofit organizations, as well as others that fall within the broad definitions of “public accommodations.” Arent Fox has substantial experience in advising clients on compliance with these obligations, and defending clients in legal proceedings before agencies and courts across the country.

A particular focus of our public accommodations practice concerns the Americans with Disabilities Act (the ADA) and related federal, state, and local laws. We regularly advise commercial landlords and tenants about their respective ADA and fair housing obligations in lease agreements and new construction and alterations.

Our public accommodations practice is not limited to ADA matters. Federal, state, and local laws also prohibit discrimination based on a broad array of protected groups. We regularly advise our clients on how to conduct business without exposing themselves to discrimination claims and represent them in litigation over such matters.
