Alan is a partner in the Communications, Technology & Mobile group, the Antitrust & Competition Law group, the Government Relations/Political Law group and the Sports Law group. Alan practices regularly in front of the FCC, and is nationally recognized for his advocacy and transactional skills. Alan’s clients’ success rate in FCC proceedings and other advocacy matters is extremely high, and Alan also handles an array of transactional matters relating to technology and telecommunications-related agreements. He also provides seminars to in-house counsel (including for a chapter of the American Association of Corporate Counsel), and attorneys at the firm regarding how to most effectively negotiate agreements. Alan recently received an award for his contributions to the work that led to his client receiving the only national infrastructure grant given under the BTOP program, which was for more than $62 million. Client WorkAlan’s clients include providers of telecommunications, cable and IP-based services, operators of research and education networks, providers of emerging technologies, colocation providers, foundations, educational institutions, non-profit associations, professional sports teams and collegiate conferences, equipment manufacturers, and entities seeking to obtain or upgrade the cloud computing services they need for their operations. In addition, Alan represents large end-users of telecommunications, cable and IP-based services, and in-building wireless and Wi-Fi services, such as owners of sports arenas, banks, commercial office building and apartment complex owners, condominium associations and hotel owners. Alan drafts and negotiates a wide variety of agreements concerning, among other things, cloud computing services, telecommunications, cable and IP-based services, eTexts, in-building wireless services, Wi-Fi services, antennal licensing, roaming, wireless towers, and the provision of dark fiber. Alan represents clients before the FCC on matters involving universal service, e-rate, pole attachments, public rights-of-way (including Section 253 issues), public safety, digital television, voice over IP, the Telephone Consumer Protection Act, wireless and data services, cable services, cable programming, cable encryption, equipment authorization requirements, unlicensed devices, ultra-wide band, regulatory fees, and emerging technologies. Alan also represents clients in front of Congress, NTIA, DOE, DOJ and the FTC. Publications, Presentations and RecognitionsAlan was recognized as a leading telecommunications lawyer by Legal 500 for 2011 and 2012. This past October a client presented Alan with an award for his contributions to the work that led to the client receiving the only national infrastructure grant given under the BTOP program. Alan was also recently recognized by the Washington Lawyers’ Committee when he received the Vincent E. Reed award for his unique and long-standing contributions to public education. Alan moderates numerous panels and gives speeches and other presentations on a wide variety of topics, including broadband and telecommunication issues, cloud computing agreements, and best practices for drafting and negotiating agreements. Alan is also the author of many legal articles. Life Beyond the LawAlan created an award-winning geography game, GeoPlunge, which is played in more than 40 DC schools. The DC public school system has instituted an annual GeoPlunge tournament involving hundreds of children each year, which is run by the school system, the Washington Lawyers’ Committee and Arent Fox. The eighth annual GeoPlunge tournament will be held in January 2013 at the Smithsonian National Portrait Gallery. The Chancellor of the DC public school system, who presides over the award ceremony at each year’s tournament, has stated that the GeoPlunge tournament is “incredible to see” and GeoPlunge “has a catalytic effect” on our students while providing an “opportunity [that] is huge for our students.” Alan is also in charge of the firm’s business partnerships with an elementary school and a high school and supervises the firm’s attorneys and staff that work on matters performed for the schools.
