Ken Jacob’s practice is focused on national commercial real estate transactions in a variety of sectors spanning senior living, shopping centers, industrial, office, multifamily, and marinas. Ken represents private equity funds, other institutional investors, developers, real estate investment trusts, and other real estate owners, operators, and managers. He advises his clients on their acquisition, disposition, and financing transactions and in structuring the ownership, investment, and financing vehicles for such transactions. Ken also represents clients in master lease and management agreements. Ken particularly enjoys working with his clients to achieve their objectives by understanding their businesses and appreciating the practical implications of the legal terms of a transaction.

In addition to his active practice, Ken serves as the manager of Arent Fox’s business department. In this role, Ken works with the lawyers in each of the practice areas falling within the business department (real estate, corporate, bankruptcy, and tax/ERISA/estate planning), and with lawyers in other departments to ensure that the best approach is brought to bear on each representation. An example of this collaboration is Ken’s membership on the senior living and long-term care team through which partners in different practice areas work to provide integrated solutions on behalf of our clients.

Client Work

Ken’s commercial real estate experience includes both portfolio and single-asset transactions in connection with the acquisition and sale of properties and mortgage loans secured by such properties. Examples of transactions in which Ken served as lead counsel include the 2004 sale, lease-back, and manage-back of a portfolio of 20 senior living facilities in seven states for a sale price of $562 million in which Ken served as lead counsel for Horizon Bay Retirement Living, as seller, tenant, and manager, and multiple acquisitions, dispositions, and financing of individual shopping center and shopping center portfolios aggregating over $1 billion on behalf of DLC Management Corporation and its affiliates. Ken also advises DLC Management Corporation on the structuring of the entities holding its shopping center portfolio. Ken’s expertise extends to the purchase and sale of real estate companies, as illustrated by his representation of the owners of Horizon Bay Retirement Living in the company’s 2011 sale to Brookdale Senior Living.

Life Beyond the Law

Ken is married with three children. He and his family enjoy exploring the food at Washington area restaurants, hiking, skiing, and travel. Ken lived in Brussels and Paris for a total of 15 years.
