Valerie Butera focuses on complex labor and employment litigation with an emphasis on OSHA matters. She is OSHA 30 certified and has substantial training and experience in process safety management (PSM). Valerie is also actively involved in firm activities, including serving as a member of the firm’s Employment Committee.

Client Work

Valerie’s recent client work includes:

  • Assisting in the representation of petrochemical companies in response to OSHA’s Petroleum Refinery PSM National Emphasis Program and alleged violations of the hazardous communication standard.
  • Assisting in the litigation of numerous OSHA citations alleging violations of OSHA’s General Industry and Construction regulations.
  • Assisted in drafting the official response of several trade associations to the Chemical Safety Board’s 2012–2016 Strategic Plan. The response consisted of complex analyses of several highly technical areas of chemical safety, and included multiple examples of how our clients would be negatively impacted by the implementation of certain proposed changes.
  • Assisted in drafting numerous briefs before the Occupational Safety and Health Review Commission, including those filed in Secretary of Labor v. Delek Refining, OSHRC Docket No. 09-0844 (July 11, 2011), in which the Commission established a three-part test for determining when a third-party expert’s report is protected by the attorney-client privilege.

Previous Work

Prior to joining Arent Fox, Valerie served as a law clerk to the Honorable William D. Quarles, Jr. of the United States District Court for the District of Maryland. During law school, she spent her summers clerking for the Privacy Rights & Protection Staff of the Centers for Medicare & Medicaid Services and the Office of Chief Counsel for the Internal Revenue Service.

Valerie is a member of the American Bar Association, Labor and Employment Law Section, and the Committee on Occupational Safety and Health.
