Steve’s representative work includes:

• Representing leading provider of consumer and corporate identity risk management services in a putative class action alleging violations of California’s Unfair Competition Law and the Consumer Legal Remedies Act involving Bank of America’s Privacy Assist consumer protection service.
• Represented retail automotive group in federal court and administrative litigation over trademark and franchise disputes with manufacturer.
• Represented major health care provider in federal shareholder class action, federal and state derivative actions, and a Securities and Exchange Commission (SEC)  investigation alleging securities fraud and other claims. Achieved favorable settlement.
• Represented major oil company in California-wide putative class action alleging improper use of expiration dates on gift cards. Achieved favorable settlement.
• Represented national health care provider in SEC investigation of past accounting practices. Led seven month internal investigation that resulted in a restatement of financial results for 2000-2003.
• Represented software company in litigation alleging breach of license agreement. Achieved favorable settlement.
• Represented wine and spirits company in breach of trust and breach of fiduciary action brought by minority shareholder in closely held corporation. Achieved favorable settlement after Plaintiff’s counsel asked for a settlement conference during trial.
• Represented foreign government in international arbitration (ICSIDconcerning termination of joint venture agreement. Obtained dismissal of arbitration.
• Represented aerospace company in precedent setting action against London insurance broker seeking declaratory judgment that London broker was responsible for over $50 million of missing excess CGL insurance coverage. Jury verdict in favor of client on all points.
• Represented aerospace company in insurance coverage action against seven carriers seeking defense and indemnity for environmental tort actions pending in Tucson. Won summary judgment on insurers’ duty to defend. After three day bench trial, court ruled that 100% of client’s defense costs were recoverable. Obtained dismissal of insurers’ appeals.
• Represented satellite television provider in putative nationwide and state wide class actions pending in Illinois, Missouri, Indiana, and Texas regarding allegedly improper late fees. Avoided certification of class and obtained dismissals through successful enforcement of arbitration clause.
• Represented satellite television provider in multimillion dollar defense and indemnity claim against AIG. Achieved favorable settlement.
• Represented aerospace company in insurance coverage case involving coverage for large commercial dispute. Won summary judgment on duty to defend requiring insurer to pay over $6 million in defense costs. Successfully defended summary judgment ruling on appeal.
• Represented aerospace company in precedent setting action against California surplus lines insurance broker seeking declaratory judgment that California broker was responsible for over $50 million of missing excess CGL insurance coverage. Court granted summary judgment in favor of client.
• Represented satellite television provider in action seeking indemnity coverage for multiple third-party actions seeking hundreds of millions of dollars in damages. Won summary judgment that indemnity coverage was owed to client.
• Represented defense contractor in commercial arbitration with power company concerning termination of agreement for development and distribution of turbo generators. Negotiated favorable settlement.
