James E. Frankel is a senior partner in the Construction Group. His practice focuses on front-end project structuring, transactional documentation and contentious dispute resolution within the owner, architect, engineering, and construction communities. He also provides intermediary as well as business advisory services, including mergers and acquisitions structuring, within the architect, engineering, and construction arena. In addition to his M&A work, he counsels design firms through their internal transitions. Moreover, Jamie has been selected to counsel the first SPAC transition within the A/E/C community. He and his team also act as SEC counsel within the A/E/C community.

With his multidisciplinary background and strong belief in realistic approaches to problem solving, Jamie brings business solution techniques and resolution-oriented methods to serving the needs of clients.

Previous Work

Jamie’s 30-year practice within the built environment has served owners, architects, engineering, and construction clients. He developed the Transportation Infrastructure Practice which has worked on such projects as the New York City Transit Authority’s Subway System as well as the Ben Gurion International Airport and the finance, design, build, and own of rail facilities in the Middle East.

In addition, Jamie developed the Failure and Collapse Program which has worked on failure and collapse matters including the Schoharie Bridge collapse on the New York State Thruway, the John Hancock building in Boston, and currently upon the 7 World Trade Center building collapse in New York.

Jamie participated in projects such as New York’s Grand Central Station, the Museum of Modern Art, Radio City Music Hall, the Miami International Airport, and the American Airlines Arena as well as on other major international facilities. In addition he has assisted clients in the export of American construction and design work on projects in Asia, Eastern Europe, and the Middle East. He also led his team in negotiating and drafting the construction-related agreements, in behalf of the New York Yankees on their new stadium.

Jamie created the Construction Practice Group’s Project Finance Program which is designed to provide financing alternatives for social infrastructure projects such as hospitals and educational facilities to support host organizations as well as the A/E/C community.

For three years prior to entering into private law practice, Jamie served as an assistant attorney general for the state of New York. In that capacity, he served as a member of the Claims and Litigation Unit defending state agencies engaged in developing highways, buildings, and other infrastructure programs.

Professional Activities

Jamie serves on the Construction Engineering Management Advisory Board of the Russ College of Engineering and Technology, Department of Civil Engineering at Ohio University.

In addition, he served as the General Counsel of AIA-New York for 14 years.

Publications, Presentations and Recognitions

Arent Fox and Jamie were recognized by the Financial Times with a 2012 Innovative Law Firms award in the “Business of Law” category following efforts to provide a cost effective, fully integrated, streamlined approach to third party delivery of capital projects for the public and non-profit sectors.

In 2011 Legal 500 recognized the Construction Practice Group of Arent Fox by stating “clients assess the overall level of service as ‘outstanding’, and the lawyers’ industry knowledge as ‘superior to many legal practices.’” Legal 500 also noted Jamie in 2011 for his “in-depth knowledge and expertise” and stated that Jamie is “more than a lawyer, he is a trusted adviser.” In 2009 Jamie was recognized in the New York edition of Super Lawyers for his work in construction/surety, construction litigation, and mergers and acquisitions. Jamie maintains an AV Preeminent rating from Martindale-Hubbell.

Jamie has been a frequent speaker at the Construction Law Superconference. He wrote “Representing the Architect/Engineer in a Failure or Collapse,” a chapter of Construction Failures (copyright 1989), part of The Construction Law Library from Wiley Law Publications.

In addition, Jamie has lectured throughout the country on the subject of “Avoiding Commoditization and the Competition within the Professional Services Industry.”

Life Beyond the Law

Jamie has been supporting Common Ground for many years as a pro bono counsel in its mission to solve homelessness by assisting those most vulnerable, in addition to his work as General Counsel to CANstruction, Inc., whose mission is to make a significant contribution to the fight against hunger in the United States.

Jamie is also General Counsel and board member to the Salvadori Center whose mission is focused on public education within inner city schools. Further, he is General Counsel and board member of the Regional Alliance of Small Contractors which supports the advancement of minority and women owned enterprises.

Recently Jamie accepted the invitation of a board seat from the Samuel Waxman Cancer Research Foundation.

Jamie is married and has three children.
