Joseph Bowser is an associate in the Communications, Technology & Mobile practice. Joe litigates commercial disputes in federal, state, and administrative tribunals, with a particular emphasis on cases for competitive telecommunications carriers and other telecommunications-related service or content providers. He has extensive experience litigating cases and counseling clients in a wide variety of complex business disputes, including cases arising out of contract, tariff, commercial tort, statutory/regulatory claims, consumer-protection laws, and antitrust laws. Joe also helps clients draft and negotiate contracts and develop business strategies designed to move their products or services through various distribution or regulatory channels with the least possible risk.

He has tried cases in federal and state court, and has helped clients reach key victories through dispositive briefing at both the trial and appellate levels. His recent experience includes:

  • Paetec Communications, Inc. v. CommPartners, LLC, 2010 WL 1767193 (D.D.C 2010): Federal district court in DC one of the first courts in the nation to agree that client, a VoIP provider, did not owe tariffed access charges for client’s VoIP traffic.
  • Club Texting, Inc. d/b/a EZ Texting, Inc. v. T-Mobile USA, LLC (S.D.N.Y. 2010): worked on team that secured prompt, favorable settlement for mobile-marketing client whose shared short code had been suspended by wireless carrier before suit was brought.
  • In re Core Communications, Inc., 531 F.3d 849 (D.C. Cir. 2008): DC Circuit grants client's request for a writ of mandamus to the FCC to respond to the court's earlier remand relating to Commission's pricing rules regarding telecommunications traffic terminated to ISPs.
  • Hypercube, LLC v. Comtel Telcom Assets d/b/a Excel Telecommunications, Inc. (N.D. Tex. 2008): lead associate on action that led to favorable settlement of dispute arising out of client’s provision of federal and state tariffed access services predominantly in connection with toll-free calls made by wireless users.

Prior to joining Arent Fox, Joe was a litigation associate at a large regional law firm.

Joe spoke on intercarrier compensation issues at COMPTEL PLUS’s Spring 2010 Convention in Nashville.

Joe co-wrote with Solomon Wisenberg, “Not Guilty? Take the Fifth: Privilege Extends to Innocents, and Document Production Too,” National Law Journal, volume 24, no. 40; June 2002.

Life Beyond the Law

Joe spends his free time with his wife, Gabi, their sons, Sammy and Max, and their two dogs. He enjoys hiking, reading, soccer, and traveling.
