Nonprofit Financings
Our practice has a particular focus on nonprofit organizations and the issues they face. We represent nonprofit clients in all sectors, including universities, hospitals, associations, social service organizations, private schools, housing, elderly housing/nursing home operators and owners, and museums and arts organizations in the use of tax-exempt and taxable debt to finance their facilities and equipment. We have a thorough understanding of the unique concerns, and legal, tax, governance, and business needs of nonprofits and the unique interplay of regulatory factors and tax requirements as applied to nonprofits. Our representation of both borrowers and creditors in nonprofit financings enables us to structure transactions that protect creditors’ security interests while ensuring that non-profit borrowers are able to fulfill their missions. |
