Successfully Appealed Missouri and Kansas Landowners' Right to Assert Claims in Opt-in Class Action

In a key Appellate practice case, Arent Fox represented a group of Missouri and Kansas landowners in successfully appealing their case to the United States Court of Appeals for the Federal Circuit. The appellate court held in the landowners' favor that that filing a class-action complaint successfully tolled the statute of limitations for all eligible property owners to join the opt-in class. The case set a precedent for opt-in class actions in a wide variety of cases against the federal government. Reported at Bright v. United States, 603 F.3d 1273 (Fed Cir. 2010).
