Phillip represents committees of unsecured creditors, secured creditors, unsecured creditors, liquidating trustees, and indenture trustees. Phillip has experience representing debtors in large complex Chapter 11 cases including hospitals and other not-for-profit companies. Phillip’s experience includes advising distressed businesses as they evaluate their options, including Chapter 11 bankruptcy. Phillip has guided clients through the bankruptcy planning and filing process and provided assistance with selling their business or assets in bankruptcy, acquiring financing, addressing employment-related issues, bringing avoidance actions or other litigation, and accomplishing orderly wind-downs.
Phillip's recent experience includes:
- Advised international retailer Diesel USA, Inc. in a Chapter 11 filing designed to revive the company’s brick-and-mortar operations. As a result of the cost savings, Diesel aims to return to its pre-recession profitability. The case was filed in US Bankruptcy Court for the District of Delaware. With guidance from Arent Fox, Diesel was able to confirm a fully consensual Chapter 11 plan of reorganization in only 38 days.
Prior to joining Arent Fox, Phillip was an associate at a healthcare focused law firm where he represented hospital and not-for-profit debtors in large complex Chapter 11 cases.
Phillip is a member of the American Bankruptcy Institute.
