EEOC Announces Opening of 2019 and 2020 EEO-1 Filings

On April 26, 2021 the Equal Employment Opportunity Commission (EEOC) announced that the 2019 and 2020 EEO-1 Component 1 data collection is now open.

The deadline for submitting both the 2019 and 2020 EEO-1 Component 1 data is Monday, July 19, 2021. Employers should begin preparing to submit data in anticipation of the July 19 filing deadline.

The EEO-1 Component 1 report is a mandatory annual data collection that requires all private employers with 100 or more employees, and certain federal contractors with 50 or more employees, to submit workforce demographic data, including race/ethnicity, sex, and job categories. On May 8, 2020, the EEOC delayed the opening of the 2019 collection in light of the COVID-19 public health emergency. In opening the 2019 and 2020 data collection, the EEOC extended the collection period from 10 weeks to 12 weeks in recognition of the continuing impact of the pandemic on employers and the need to file for two years instead of one year.

Eligible employers that have not received a 2019 and 2020 EEO-1 Component 1 notification letter should contact the EEOC’s Filer Support Team at FilerSupport@eeocdata.org for assistance. With an established user account, employers may file the 2019 and 2020 reports using one of two methods. Employers may file online beginning on April 26, 2020 by entering their data via the EEO-1 Component 1 Online Filing System at EEOCdata.org/eeo1/signin. Employers may also upload data files through the EEO-1 Component 1 Online Filing System beginning on May 26, 2021. The uploaded data must follow the file layout(s) set forth in the EEOC-approved specifications found at EEOCdata.org/eeo1.

To assist employers with their EEO filing obligations, the EEOC has launched a website (EEOCdata.org/eeo1) containing the latest filing updates and information.
