The OFCCP Dismantles Executive Order 13950’s Enforcement Mechanisms
As we’ve reported, on his first day in office President Biden revoked Executive Order 13950, the controversial Trump administration order that prohibited federal contractors, subcontractors, and grant recipients from providing certain workplace diversity training and programs.
In keeping with Biden’s mandate, the OFCCP has announced that it is shutting down the revoked order’s enforcement mechanisms. Specifically, the OFCCP:
- Has rescinded the Frequently Asked Questions regarding Executive Order 13950;
- Will close the phone hotline and e-mail address created to collect complaints about alleged non-compliance with Executive Order 13950;
- Will administratively close all complaints regarding alleged non-compliance with Executive Order 13950 received through the hotline or any other means; and
- Won’t require contractors or subcontractors to:
- Provide notice of unions and employee representatives of any commitments or contract terms that Executive Order 13950 required;
- Include any provisions in subcontracts or purchase orders to bind their subcontractors and vendors to the terms of Executive Order 13950, or take action to enforce those provisions.
