Last November, Californians voted to enhance the privacy protections available
to them under the California Consumer Privacy Act (CCPA). Several other state
legislatures also have introduced and debated privacy bills with varying degrees of similarity to CCPA. One state – Virginia – already has a new privacy law inspired by (but not the same as ) CCPA, which takes effect on January 1, 2023.
The potential for myriad state privacy laws makes a complex topic – privacy – even more complicated. Consumer confusion about what privacy rights are available and adapting compliance tools to meet evolving and inconsistent state law requirements are some of the challenges that businesses face over the next few years.
