Congress Urges HHS Action to Protect 340B Program

Multiple members of Congress issued a letter to HHS Secretary Alex Azar on September 14, 2020, urging him to use his authority to compel pharmaceutical manufacturers to comply with the laws and regulations governing the 340B Drug Pricing Program.

In recent weeks, news has surfaced that multiple drug manufacturers who are required to offer steeply discounted purchase prices on certain drugs to participating 340B Covered Entities would refuse to offer those prices to so-called “contract pharmacies” who dispense drugs on behalf of the Covered Entities, contrary to agency guidance.
